What Identification Does a Notary Need

You may have heard of incidents where one side falsely claimed they did not sign a document, disadvantaging the other party. Some of them incurred losses of up to millions of dollars. What Identification Should I Bring to a Notary Signing?

Every notary in the country has a different set of requirements for identification. The only way to know what you need is to call your local office and ask! In most cases, the notary public will ask each signer to present proof of identity before notarizing any document. The law mandates a notary public to refuse service to a customer who fails to present proper identification. 

Regardless of the specific requirements, you'll need to present at least one of these acceptable forms of identification:

  • A state identification card with a photo 
  • U.S Passport
  • U.S military identification card
  • A state-issued driver's license  
  • Resident alien identification card

Unacceptable documentation during a notary signing includes:

  • Birth certificate
  • Marriage certificate
  • Debit cards
  • Credit cards
  • Social security cards

The final requirement is a trustworthy witness who will be present when the notary public notarizes your document

Why Do I Need a Witness for My Document Notarization?

A witness is an unbiased third person who is solely present to observe the individual signing of the documents. If you don't have an acceptable form of identification, the witness will vouch for your identity However, they cannot do this if you left your identification documents at home, but only if you have a legitimate cause for not having them. You may have a coworker, a relative, or an acquaintance serve as your witness. They must be at least 18 years old and of sound mind at the time of signing.

The witness must present their ID and sign an affidavit that states the following:

  • The witness knows the signer
  • The witness has no financial interest in the notarized document
  • The signer doesn't possess an acceptable form of identification
  • The signer is unable to obtain an acceptable form of identification 

What Documents Need To Be Notarized?

You're free to notarize any document. However, prioritize notarizing crucial files such as:

  • Mortgage documents
  • Commercial leases
  • Employment contracts
  • Legal affidavits
  • Company incorporations
  • Passport application documents
